Terms of Service

BiliGuide is an online tool that displays guidelines for assistance in managing hyperbilirubinemia in newborn premature and full-term infants. By using BiliGuide, Robert L Stavis, LLC (RLS-LLC), the developer of BiliGuide, grants any healthcare professional a limited non-exclusive license for its use, subject to the following terms and conditions:

1. BiliGuide is provided solely as an aid to clinicians managing newborn jaundice and hyperbilirubinemia.
2. The information and graphs displayed in BiliGuide are not intended, nor may they be used as a substitute for professional evaluation and judgment.
3. BiliGuide is provided "as is" without warranties of any kind, express or implied.
   • RLS-LLC is not responsible for User errors in data entry, calculation and/or display errors, or changes in professional guidelines or recommendations, any of which could contribute to erroneous clinical management.
   • Citation of the references from which its graphs are derived does not imply review or endorsement by the journals in which the articles were published or by any professional society.
   • The graphs for infants <35 weeks’ gestational age are based on the publication Hyperbilirubinemia in premature infants <35 weeks’ gestation: a chronologic age format for graphing consensus-based recommendations. J. Perinatol. (in press) and are subject to the limitations described in the article.
   • The graphs for infants ≥35 weeks’ gestational age are derived from algebraic equations based on tabular data provided in the AAP guidelines and are not duplicated from the AAP graphs. As a result, there may be differences between the graphs displayed in BiliGuide and the AAP graphs.
   • BiliGuide may be modified, suspended, or discontinued at any time and without notice. Versions of the software that may have been used in the past may not be retained. RLS-LLC does not guarantee uninterrupted availability of BiliGuide or the preservation or availability of stored data.
   • These Terms of Service apply without limitation to any printed documents generated directly by BiliGuide or generated by the User from information displayed by BiliGuide.
4. Gestational age, bilirubin levels, the age at which the bilirubin was obtained, and the existence of 1 or more risk factors related to hyperbilirubinemia are saved in a database and identified by the Patient ID code; patient names, addresses, dates-times of birth, dates-times of bilirubin measurements, hospital names, or information about the computer used to access BiliGuide are not saved in the BiliGuide database. Data are not saved in a BiliGuide audit trail.
5. Data for a patient are identified in the database only by a random system-generated 5-character Patient ID code. The code may be saved in BiliGuide for a code-identified User and/or a code-identified Team so that the User and/or Team can access the data in subsequent sessions. With over 33 million code variations, it is unlikely (but not impossible) that the patient’s data could be accessed by someone who accidentally or maliciously enters the specific code of the Patient, User, or Team.
6. Users and Teams are registered by random system-generated 5-character alphanumeric codes. With over 33 million code variations for each code type, it is unlikely (but not impossible) that patient data could be accessed by someone without the Patient ID code who accidentally or maliciously enters the associated User or Team code.
7. Patient data are deleted from the database at approximately 48 weeks postmenstrual age or 8 weeks of age, whichever is later, using the date of initial data entry as a stand-in for the date of birth. Copies of the database may remain temporarily in backups or other systems maintained by the hosting provider and are subject to the provider’s retention and access practices.
8. User registration requires entry of the user’s continent for the purpose of understanding the geographic distribution of BiliGuide users, and while the application does not collect the patient’s address information, the association with the User allows inference of the patient’s continent. The IP address of the computer used to access BiliGuide is not recorded or saved in the BiliGuide database but may be recorded by the web server.
9. RLS-LLC does not provide a service for retrieving saved bilirubin values other than through the functionality available within BiliGuide.
10. RLS-LLC disclaims liability for claims, losses, or damages arising from or related to the use of BiliGuide or its content to the fullest extent permitted by applicable law.
11. Use of BiliGuide does not establish a clinician-patient relationship between RLS-LLC and any patient or create any responsibility on the part of RLS-LLC for clinical decisions.
12. Governing Law and Venue: These Terms and any dispute arising out of or relating to BiliGuide, its use, or these Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any legal proceeding arising out of or relating to BiliGuide or these Terms shall be brought in a state or federal court having jurisdiction in Pennsylvania. This provision does not deprive a User of any nonwaivable protections provided by applicable law.

By using BiliGuide, the User hereby acknowledges and agrees to the foregoing terms and conditions.
